THE INDY FAMILY ARGUMENTS - 10 IDEAS DOING THE ROUNDS

This page explains what people are actually talking about inside the movement right now. For each one: What folk are saying, Why they say it, What the legal / practical reality is.


UDI - "Just Walk Away / Declare Now

What they say: We've had pro-indy majorities at Holyrood since 2011, Westminster keeps refusing a Section 30. Just declare. Kosovo did it.

Why:

Why: Find Out Now poll Aug 4-10 - 1,020 Scots - 45% would back Holyrood declaring independence without Westminster permission. 69% of SNP voters.

Reality

ICJ Kosovo Advisory Opinion 2010 said a declaration itself is not illegal under international law, but did not say it creates a state. No tax, police, courts, or central bank would automatically transfer. Catalonia 2017 declared - no country recognised it. Legal scholars McCorkindale & McHarg call it "a less certain and less satisfactory route".

"We ARE Already Independent" - Constitutional Resumption


What they say

Liberation Scotland / Salvo argument - sovereignty was never ceded in 1707, it was paused. Treaty of Union broken, so resumption. Claim of Right 1689 & 1989 - people sovereign.

Why

Baltic precedent - states that were occupied resumed, not seceded.

Reality: Claim of Right IS real Scots constitutional law. But UK position is Scotland entered Union voluntarily via Acts of Union 1706/1707. No international court has ruled the Treaty void. Baltics were illegally annexed by USSR - different legal category under UN.


"Everyone WILL Work With Us


What they say: rUK is our biggest market, EU will fast-track us, EFTA tomorrow, businesses need us so they'll sort it.

Why: Reaction to Project Fear - 2014 warnings that didn't happen.

Reality

Trade WILL continue, but terms change. Brexit proved it - trade continued but with customs declarations, SPS checks, and ~£600+ per lorry costs. EU: Spain said it would not veto a legal independence but no automatic entry - would have to apply under Article 49. EFTA needs unanimous consent of 4 states.

De Facto Referendum - Use Holyrood 2026 List Vote

What they say: Graeme McCormick 9 Steps plan - if pro-indy parties get 50%+1 of list votes, that's a mandate to start negotiations.

Why: SNP's old Plan B, now pushed by Alba and Pensioners for Indy.

Reality: List vote under AMS was designed to be proportional - your graphic "They Sawed Off Our Knees" shows the frustration - hundreds of thousands of votes, zero extra power. Unionist parties would frame 2026 as about NHS / schools, not independence. UK Government has already said it would not accept a Holyrood vote as a referendum substitute.


"Civil Disobedience - Next Step?

What they say: Non-violent mass demos, civic resistance if Westminster continues to refuse.

Why: Feeling that marches and mandates are ignored.

Reality: Right to protest is protected under ECHR Articles 10 & 11. Gets attention but does not itself create legal change. Risk of arrest for road blocking etc under Public Order Act. Movement split on effectiveness - some say march in Edinburgh does not influence Westminster.

"GERS Lie / Fiscal Trap"

Proven outcomes that speak for themselves and make a meaningful difference for your business.

"Devo-Max Was Promised Then Stolen"

The Vow, 2 days before 2014 - near federalism, home rule, signed by Cameron/Miliband/Clegg on Daily Record front page. Then EVEL, Scotland Act 2016 made Sewel a convention not enforceable, Internal Market Act 2020.

Why

Bridge between soft No and Yes - broken promise on powers and EU.

Reality

The Vow WAS made, Smith Commission followed, Scotland Act 2016 delivered tax powers but not Devo-Max / Home Rule. EU membership was presented as safer inside UK - Scotland voted 62% Remain, all 32 councils, and left anyway in 2020.


"SNP Don't Actually Want Independence"


What they say: Most corrosive chat right now - "SNP don't want indy, they just shout it to keep votes".

Why

Frustration at no progress since 2014, no Section 30 request since 2022 Supreme Court case.

Reality

SNP has been in power since 2007, pro-indy majority at Holyrood since 2011 and at Westminster 2015-2024. Supreme Court 2022 ruled Holyrood cannot hold indyref without Section 30. SNP policy is now gradualist - build support then referendum. Other parties - Greens, Alba, ISP - say that's too slow.

"The UN / Decolonisation Route"

What they say

Take Scotland to UN, letter to UN Decolonisation Committee, we are a colony. Why: Liberation Scotland graphic of open door to UN HQ.


Reality

UN Charter Article 2(7) - UN does not intervene in internal matters of a member state. UK is P5 with veto. Decolonisation Committee (C24) list is for non-self-governing territories - former overseas colonies. Scotland not on it. Value is political - to evidence that internal democratic route is blocked, which is part of self-determination tests under international law.


"Support for Independence vs Support for UDI Are Different Questions"


What they say: Yes Stirling graphic viral - "SCOTLAND WOULD VOTE YES - SUPPORT FOR UDI IS A DIFFERENT QUESTION" Why: Honest framing - polls show 52% would vote Yes tomorrow, but only 35-45% back UDI when don't knows included. Backing independence does NOT equal backing every route. Reality: This is why your site matters - explaining the difference between the goal and the route. People can be 100% Yes and disagree 100% on how to get there.

A FINAL WORD FROM ALAN.

On this issue  at least.

So I’ll say it plain, as a Scot, from deep down in my heart. These are just a few of the cracks that are splitting our family right now - and if we don’t fix them, we will go nowhere. Absolutely nowhere. We have spent ten years arguing with each other about how we get there, while Westminster sits and laughs at us for not getting there at all. We forgot who we are. We are not a political party. We are not a flag-waving cult. We are not here to worship a leader or a logo.

We are the grassroots. We are the people.

We are the ones who were out in the wind and rain in 2012, 2013, 2014 - with a table, a few leaflets, and a belief in our chests that Scotland could be better than this. Better than managed decline. Better than being told to know our place. We built the biggest grassroots movement these islands have ever seen - not with money, not with the BBC, not with the backing of the state - but with heart. Pure, bloody, Scottish heart. And look at us now. Sniping at each other on Facebook. Scoring points while Scotland is being stripped for parts.

Enough. Just... enough.


If we can find it in ourselves to pull together again - to get this family back round the table, to respect each other even when we disagree on the route - then we will be unstoppable. Just like we were in 2014. And I promise you this - if we do that, the people in power will have to listen. Both sides of the border, I’m talking about. London and Edinburgh. They are terrified of one thing and one thing only - a united Scottish people who refuse to be divided any longer. So let’s give them something to be terrified about.

Scotland is waiting. Let’s get to work.
